General Terms and Conditions (GTC)
§1 Scope of application
(1) These GTC apply to all contracts between FHU SOLID Adam Sekuła and its customers for the sale and delivery of goods.
(2) Deviating or conflicting terms and conditions of the customer shall not be recognized unless FHU SOLID Adam Sekuła has expressly agreed to their validity in writing.
§2 Conclusion of contract
(1) The presentation of goods on the website www.apreggio.com does not represent a legally binding offer. A contract is only concluded when the customer places an order and FHU SOLID Adam Sekuła confirms the order.
(2) The customer is obliged to provide truthful information when placing the order.
(3) FHU SOLID Adam Sekuła reserves the right to refuse orders.
§3 Prices and terms of payment
(1) The prices are inclusive of the statutory value added tax.
(2) The customer can pay for the goods by advance payment, PayPal or credit card.
(3) Payment must be made within 14 days of the order.
§4 Delivery and shipping costs
(1) Delivery will be made within 3-5 business days after receipt of order.
(2) The shipping costs are 5,90 € within Germany.
(3) From an order value of 50 € the shipping within Germany is free of charge.
§5 Retention of title
The delivered goods remain the property of FHU SOLID Adam Sekuła until full payment.
§6 Right of withdrawal
(1) The customer has the right to revoke the contract within 14 days without giving reasons.
(2) The revocation period begins on the day on which the customer or a third party named by him has taken possession of the goods.
(3) The revocation must be declared in writing or by e-mail.
(4) In the event of revocation, the customer shall bear the costs of the return shipment.
§7 Warranty
(1) The statutory warranty rights apply.
(2) The customer must report obvious defects in writing within two weeks after receipt of the goods.
§8 Liability
(1) FHU SOLID Adam Sekuła shall be liable without limitation in the case of intent and gross negligence.
(2) In case of simple negligence FHU SOLID Adam Sekuła is only liable in case of violation of essential contractual obligations.
(3) Liability in the case of simple negligence is limited to the foreseeable damage typical for the contract.
(4) Liability for indirect or consequential damages shall be excluded, except in cases of intent or gross negligence.
§9 Data protection
(1) FHU SOLID Adam Sekuła collects, processes and uses personal data of the customer exclusively within the framework of the statutory provisions.
(2) The customer has the right to information, correction and deletion of his data.
§10 Final provisions
(1) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
(2) Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions.
(3) The place of performance and jurisdiction shall be the registered office of FHU SOLID Adam Sekuła, insofar as the customer is a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law.
